Vote to pass a bill that authorizes a landlord to deliver an electronic notification of eviction, effective August 19, 2015.

Highlights:

  • Authorizes a landlord to deliver an “electronic notification” of eviction if he or she performs the following actions (Sec. 1):
    • The landlord receives the tenant’s written consent; and
    • The landlord and tenant complete a consent process in which either individual sends consent and the other replies affirmatively by electronic transmission.
  • Defines “electronic notification” as a message sent to an individual’s authorized electronic service address to notify him or her that a document is served (Sec. 3).
  • Prohibits a landlord from refusing to enter into a lease because the prospective tenant declines to consent to electronic service (Sec. 2).
  • Specifies that the original electronic address is considered to be the correct functioning address, unless either the landlord or the tenant performs the following actions (Sec. 2):
    • The individual repeats the consent process with a different electronic address; or
    • The individual notifies the other individual, in writing, that he or she no longer has an electronic address.
