  • Extends the date by which a state is required to submit a plan to the Environmental Protection Agency (EPA) to address carbon dioxide emissions until judicial review of the Clean Air Act is complete (Sec. 2).
  • Exempts a state from the requirement to submit a carbon emissions plan, if the governor determines and notifies the Administrator of the EPA of the following circumstances (Sec. 3):
    • The requirement has a “significant adverse effect” on the state's’ residential, commercial, or industrial rate-payers; or
    • The requirement has a “significant adverse effect” on the reliability of the state’s electricity system.
