Title: Authorizes Retail Sale of Marijuana

Vote Smart's Synopsis:

Vote to pass a bill that authorizes certain sales of marijuana, effective October 1, 2015.

Highlights:

  • Authorizes a medical marijuana dispensary to sell “limited marijuana retail product” to an individual 21 years or older without a medical marijuana card if the following conditions are met (Sec. 2):
    • The individual presents proof of age;
    • The dispensary verifies the proof of age as 21 or older;
    • The dispensary sells less than one-quarter ounce of dried leaves or flowers to an individual per day; and
    • The dispensary sells less than 4 plants that are not flowering to an individual.
  • Defines “limited marijuana retail product” as marijuana seeds, dried leaves of marijuana, flowers of marijuana, and a marijuana plant that is not flowering (Sec. 2).
  • Authorizes a city or county to prohibit the sale of limited marijuana retail product within the city or county jurisdiction (Sec. 2).
  • Specifies that the provisions of this bill are repealed on December 31, 2016 (Sec. 3).
