Title: Requires DNA Sample from Individuals Arrested for Certain Crimes

Highlights:

  • Requires state police to collect the DNA sample of an individual arrested for certain crimes including, but not limited to, criminal homicide, trespassing, and simple assault (Sec. 1).
  • Exempts an individual from providing a DNA sample if he or she has previously provided a sample for the state DNA database and databank (Sec. 1).
  • Authorizes state police to conduct a “modified DNA search” in an unsolved case, including a search of the DNA database to determine if a crime scene DNA profile is likely to have originated from the relative of an individual with a recorded DNA profile (Sec. 1).
  • Prohibits a DNA sample or record collected under the provisions of this bill from being used for any non-law enforcement identification purpose (Sec. 3).
  • Authorizes an individual to request the expungement of his or her DNA sample from the state database or databank if the individual meets certain conditions including, but not limited to, the following conditions (Sec. 3):
    • The individual’s conviction is reversed;
    • The individual’s charge is dismissed; or
    • The individual is pardoned.
  • Specifies that the authorization of DNA sample expungement does not apply to an individual who has been arrested or convicted for another crime for which a DNA sample is required (Sec. 3).
  • Requires state police to establish rules to verify the accreditation of a DNA laboratory and to require continuing education for laboratory personnel (Sec. 3).
