Vote Smart's Synopsis:

Vote to pass a bill that authorizes a parent or medical professioinal to administer medical marijuana treatments to certain students on school property.

Highlights:

• Authorizes a school district to adopt a policy that authorizes the administration of medical marijuana to a student within the following locations (Sec. 9):
• A location on school grounds;
• A school bus; or 
• A school-sponsored event. 
• Requires the administration of medical marijuana to a student to be performed by a parent or medical professional that is employed to assist in administering medical marijuana (Sec. 9).
• Requires a student who is administered medical marijuana to hold a “valid recommendation” for medical marijuana (Sec. 9). 
• Prohibits a “primary caregiver” from cultivating, transporting, or possessing more than 36 medical marijuana plants, unless the caregiver has 1 or more patients who, based on medical necessity, require the caregiver to maintain a larger plant count (Sec. 3).
• Defines “primary caregiver” as an individual who is 18 years or older, has a “significant responsibility” for managing the well-being of a patient with a debilitating medical condition, and has at least 1 of the following relationships with the patient (Sec. 3):
• A parent of the patient;
• An individual who advises the patient on the use of medical marijuana products, but does not possess, provide, cultivate, or transport marijuana on the patient’s behalf;
• An individual who purchases or transports marijuana to the patient; or
• An individual who grows marijuana for the patient. 
• Prohibits any individual or entity, other than a properly licensed medical marijuana business, from cultivating more than 99 medical marijuana plants (Sec. 3).
