Title: Expands Insurance Requirements for Short-Term Rental Companies

Vote to pass a bill that expands the personal injury and property damage insurance coverage requirements for transportation network and short-term rental companies, effective January 1, 2016.

Highlights:

  • Defines “transportation network company” as an entity operating in the state that uses an application to connect riders to drivers and provides prearranged rides, excluding entities arranging non-emergency medical transportation for individuals qualifying for Medicaid or Medicare (Sec. 3).
  • Requires transportation network companies or their drivers to maintain the following liability insurance coverage while a driver is logged into the company’s application, and available to receive requests, but not engaged in a pre-arranged ride (Sec. 3):

    • $125,000 for death and bodily injury per person;

    • $250,000 for death and bodily injury per incident; and

    • $25,000 for property damage.

  • Requires transportation network companies or their drivers to maintain the following liability insurance while a driver is engaged in pre-arranged rides (Sec. 3):

    • $1 million for death and bodily injury; and

    • $50,000 for property damage.

  • Requires transportation network company drivers to maintain the following liability insurance coverage when not operating for a transportation network company if the driver is in an agreement with a company (Sec. 3):

    • $100,000 for death and bodily injury per person;

    • $200,000 for death and bodily injury per incident; and

    • $25,000 for property damage.

  • Requires automobile insurance coverage to come from a provider that is a member of the Florida Insurance Guaranty Association (Sec. 3).

  • Defines “short-term rental property companies” as an individual or organization that pre-arranges short-term rentals for compensation using an application to connect a renter with an individual who makes said property available (Sec. 2).

  • Requires short-term rental property companies to provide the following insurance coverages to an individual who makes a rental property available for claims occurring due to the engagement in a rental contract (Sec. 2):

    • $1 million against physical damage or loss claims to property per occurrence and $2 million for each property per policy period; and

    • $1 million to cover personal injury claims.

  • Authorizes personal insurance companies to refuse coverage for claims of damage made by a contracted renter (Sec. 2).
