Title: Establishes Regulations for Transportation Network Company Services

Vote to pass a bill that establishes regulations for transportation network company services, effective July 1, 2015.

Highlights:

  • Defines “transportation network company” (TNC) as a licensed business entity that uses digital network services or software application services to connect passengers to TNC services (Sec. 2).
  • Specifies that a TNC does not provide certain for-hire motor carrier services including, but not limited to, taxicab or limousine services (Sec. 2).
  • Authorizes the Oklahoma Corporation Commission to issue, revoke, or deny a permit for a TNC (Sec. 4).
  • Establishes an annual permit fee of $5,000 for each TNC (Sec. 4).
  • Requires a TNC to perform criminal background checks and driving history checks on all applicants, and to deny employment to certain applicants including, but not limited to, the following applicants (Sec. 10):
    • Applicants who have had more than 3 moving traffic violations or 1 major violation in the previous 3 years;
    • Applicants who have been convicted of driving under the influence of drugs or alcohol in the previous 7 years; and
    • Applicants who are a match on the National Sex Offender Registry database.
  • Requires a TNC driver logged on to the TNC’s digital network and available to receive transportation requests but not engaged in a prearranged ride to meet the following primary automobile liability insurance requirements (Sec. 16):
    • $50,000 for death and bodily injury per person;
    • $100,000 for death and bodily injury per incident;
    • $25,000 for property damage; and
    • Uninsured motorist coverage.
  • Requires a TNC driver logged on to the TNC’s digital network and engaged in a prearranged ride to meet the following primary automobile liability insurance requirements (Sec. 16):
    • $1,000,000 for death, bodily injury, and property damage; and
    • Uninsured motorist coverage.
  • Requires a transportation network company to adopt a nondiscrimination policy on the basis of destination, race, color, national origin, religious belief, religious affiliation, sex, disability, or age with respect to passengers (Sec. 14).
