Title: 2015-2017 Biennium Education Budget

Vote to pass a bill that prohibits a public school student from using school facilities designated for the opposite sex.

Highlights:

  • Prohibits an individual from using a facility that is not designated for his or her “sex” (Art. 2).
  • Defines “sex" as the physical condition of being male or female, which is determined by an individual’s chromosomes and is identified at birth by his or her anatomy (Art. 2).
  • Requires the following public school facilities or settings accessible by multiple students at the same time to be designated for the exclusive use by students of the male sex only or female sex only (Art. 2):
    • Student restrooms;
    • Student locker rooms;
    • Student changing rooms;
    • Student shower rooms; and
    • Student settings where a student may be in a state of undress in the presence of other students.
  • Authorizes a public school to provide certain facilities that do not violate the provisions of this bill, such as single-occupancy facilities or controlled use of faculty facilities, upon a student’s request for special circumstances (Art. 2).
