Title: Authorizes the Sale of Raw Milk

Vote to pass a bill that authorizes the direct sale of raw milk.

Highlights:

  • Establishes a “small herd exemption permit” to allow a small herd owner to sell raw milk or raw milk products for human consumption if the raw milk products meet certain requirements, including, but not limited to the following requirements (Secs. 1 & 3):
    • The raw milk or raw milk products are produced by a dairy herd composed of 7 or fewer lactating cows, 15 or fewer lactating goats, or 15 or fewer lactating sheep; 
    • The raw milk or raw milk products are cooled to 45 degrees Fahrenheit or less within 2 hours after milking;
    • The raw milk or raw milk products are tested at least 4 times in separate months during any consecutive 6-month period for bacteria, coliform, and somatic cells;
    • The raw milk or raw milk products are sold on the premises for which the small herd exemption permit is issued; and
    • The raw milk or raw milk products are packaged in a container with a label identifying that the product has neither been pasteurized, nor inspected by the state, and that the consumer assumes liability for health issues as a result of consumption of the product. 
  • Exempts raw milk and raw milk products produced by small herd exemption permit holders from standard licensing, sanitation, and labeling requirements and from some quality requirements (Sec. 1). 
  • Establishes a fee of up to $20 for the issuance and renewal of a small herd exemption permit (Sec. 6).
