Vote to pass a bill that prohibits an individual from selling an e-cigarette to a minor.

Highlights:

• Prohibits an individual from selling, bartering, or giving an “e-cigarette” or a “nicotine liquid container” to a minor (Sec. 3).

• Defines “e-cigarette” as an electronic oral device that provides a nicotine vapor or any other substances which simulate smoking when used or inhaled (Sec. 2).

• Defines “nicotine liquid container” as a bottle or other container of any substance containing nicotine which is sold, marketed, or intended for use in an e-cigarette (Sec. 2).

• Classifies the sale or gift of an e-cigarette or nicotine liquid container to a minor as a misdemeanor (Sec. 11).

• Prohibits a minor from procuring or attempting to procure an e-cigarette or nicotine liquid container for personal use or for another minor’s use (Sec. 3).

• Specifies that a minor who procures or attempts to procure an e-cigarette or a nicotine liquid container is subject to a fine of up to $100 or 48 hours of community service (Sec. 11).

• Requires an individual to conduct the sale of an e-cigarette or a nicotine liquid container face-to-face (Sec. 6).

• Authorizes the sale of e-cigarettes and nicotine containers by a vending machine in an age-controlled location where a minor is prohibited from entering (Sec. 6).

• Prohibits an individual from selling a nicotine liquid container that is not child-resistant (Sec. 3).
