Title: Amends Mandatory Sentences for Certain Drug Offenses

Vote to pass a bill that amends mandatory sentences for certain drug offenses, effective October 1, 2015.

Highlights:

  • Repeals the mandatory sentence of at least 10 years imprisonment and a maximum fine of $100,000 for first and second time convictions of certain drug offenses, including, but not limited to, the following offenses (Sec 1):
    • Distributing or dispensing a dangerous controlled substance;
    • Processing a dangerous controlled substance with intent to distribute or dispense; and
    • Manufacturing, distributing, or processing a counterfeit substance.
  • Requires an individual convicted of certain drug offenses to be sentenced to at least 2 years imprisonment (Sec. 1).
  • Requires an individual convicted of a first drug offense to be sentenced to one of the following sentences (Sec. 1):
    • A maximum imprisonment of 20 years; or
    • A maximum fine of $100,000.
  • Requires an individual convicted of a second drug offense to be sentenced to both of the following sentences (Sec. 1):
    • A maximum imprisonment of 20 years; and
    • A maximum fine of $100,000.
  • Requires an individual convicted of a third drug offense to be sentenced to at least 2 years imprisonment without parole (Sec. 1).
  • Requires an individual convicted of manufacturing or possessing equipment that suggests intent to manufacture dangerous controlled substances for the purpose of selling or dispensing to be sentenced to the following sentences (Sec. 1):
    • A minimum imprisonment of 10 years; and
    • A maximum fine of $100,000, if the person has been convicted at least once.
