Title: Amends Workplace Discrimination Standards

Highlights:

  • Requires a plaintiff in an employment-related lawsuit to prove that discrimination by an employer was a “motivating factor” in the alleged unlawful employment decision or action rather than a “contributing factor” (Sec. A).
  • Prohibits an employer from firing or retaliating against an employee due to the employee reporting to authorities, or refusing to comply with, an unlawful act committed by their employer or supervisor if the employee does not hold one of the following positions (Sec. A):
    • The employee is exempt from overtime compensation;
    • The employee is a supervisor, manager, officer, or executive employee; or
    • The employee is employed to provide a professional opinion. 
  • Requires a plaintiff in a lawsuit against an employer, who allegedly retaliated or discriminated against the employee, to prove that the employee’s right to report or refuse to participate in an unlawful activity was a “motivating factor” in the alleged retaliation or discrimination (Sec. A).
