Title: Prohibits Conversion Therapy on Minors

Highlights:

  • Classifies the performance of “aversion therapy” or “conversion therapy” on an individual under the age of 18 as unprofessional conduct, punishable by a court-determined fine of no more than $25,000 (Sec. 3).
  • Defines “aversion therapy” as a practice, treatment, or therapy involving electrical shock, extreme temperatures, prolonged isolation, and other procedures intending to cause pain, discomfort, or unpleasant sensations to the client or patient (Sec. 2).
  • Exempts a practice, treatment, or therapy that is within the Department of Health’s standards of practice for licensed health care providers from the definition of aversion therapy (Sec. 2).
  • Defines “conversion therapy” as a practice or treatment that seeks to change an individual’s sexual orientation, gender identity, gender expression, romantic attraction or feelings toward an individual of the same gender (Sec. 2).
  • Excludes the following from the definition of conversion therapy (Sec. 2):
    • Counseling that provides assistance to an individual undergoing gender transition;
    • Counseling that provides acceptance, support, and understanding of an individual; and
    • Counseling that facilitates an individual’s coping, social support, and identity exploration and development.
