Title: Prohibits Smoking in Motor Vehicles with Minors

Vote to pass a bill that prohibits an individual from smoking in a motor vehicle when a minor is present.

Highlights:

  • Prohibits an individual from “smoking” in a motor vehicle when an individual under the age of 18 is present in the vehicle (Sec. 1).
  • Defines “smoking” as the following (Sec. 1):
    • The inhaling, exhaling, burning or carrying of any lighted or heated cigar, cigarette, pipe or other tobacco or plant product intended for inhalation;
    • The use of an electronic smoking device that creates an aerosol or vapor intended for inhalation; and
    • The use of any oral smoking device for the purpose of circumventing the provisions of this bill.
  • Classifies a violation of the provisions of this bill as a misdemeanor, punishable by the following fines (Sec. 1):
    • $100 for a first offense, which will be waived if the individual completes an approved smoking cessation course; and
    • $100 for a second or subsequent offense.
