Title: Authorizes Industrial Hemp Research

Vote to pass a bill that authorizes a licensed individual to grow industrial hemp for commercial, research, and development purposes.

Highlights:

  • Authorizes an individual, business, or institution of higher education to apply to the Department of Agriculture for a license to grow hemp for commercial or research and development purposes, including, but not limited to, agricultural, ecological, and marketing research (Sec. 1). 
  • Requires the Department of Agriculture to adopt rules to carry out the provisions of this bill, including, but not limited to, the requirements for licensure, inspection, and fees (Sec. 1).
  • Requires New Mexico State University to establish a New Mexico Industrial Hemp Research and Development Fund to be administered by the department (Sec. 1).
  • Specifies that the classification of marijuana, tetrahydrocannabinols, and their derivatives as Schedule 1 controlled substances does not apply to the authorized research and development of industrial hemp (Sec. 3).
  • Specifies that the definition of marijuana does not include the plant Cannabis sativa L. and any part of the plant containing a delta-9-tetrahydrocannabinol concentration of three-tenths of a percent or less based on dry weight (Sec. 2).
