Highlights:

  • Prohibits an owner, operator, or tenant of a business, commercial building, or multifamily housing property within any city, town, or county from taking the following actions (Secs. 1 & 2):
    • Requiring an owner, operator, or tenant to measure and report energy usage and consumption;
    • Imposing a tax, fee, assessment, charge, or return deposit on a consumer, owner, operator or tenant for “auxiliary containers”; or
    • Regulating the sale, use, or disposition of “auxiliary containers” by an owner, operator or tenant.
  • Defines “auxiliary container” as a reusable or disposable bag, box, beverage can, bottle, cup, or container made out of cloth, plastic, or other similar materials that is used for transporting merchandise or food (Secs. 1 & 2).
