Highlights:

 

  • Amends the requirements for changing your gender on your birth certificate in regards to the required affidavit from a licensed physician by adding the following (Sec. 1):

    • The physician has a bona fide physician-patient relationship with the birth registrant;

    • The physician has treated and evaluated the birth registrant and has reviewed and evaluated the birth registrant’s medical history; and

    • The birth registrant has had appropriate clinical treatment for gender transition and has completed the transition to the new gender.

  • Prohibits the new certificate from being marked as amended and in any way revealing the original language that was changed (Sec. 1).

  • Prohibits the department from seeking additional medical information or records once all required documents have been submitted (Sec. 1).

  • Amends the circumstances under which the Department of Health can establish a new birth certificate for an individual to include the following circumstances (Sec. 1):
    • The presentation of an affidavit from a licensed physician or mental health provider that affirms that the applicant’s gender designation should be changed to align with their gender identity; or
    • The presentation of an order from a circuit court judge that finds the affidavit to have been legitimately issued.
  • Prohibits the department form marking the new birth certificate as amended or revealing the original language changed by the amendment (Sec. 1).
  • Prohibits the department from seeking additional medical information or records (Sec. 1).
