Committing a lewd act upon a child under the age of 16.
Defines a “default level 4 registration” as the default registration level of an offender who has not been reviewed by the board, does not meet the requirements of a default level 5 offender, or for an offender that received a risk-based designation, and then is subsequently convicted of a felony nonsexual offense (Sec. 1).
Requires a convicted offender to register with the county sheriff at the following times, after being released from prison or placed on parole (Sec. 3):
Annually for 10 years, for a level 1 offender;
Annually for 20 years, for a level 2 offender;
Annually for 30 years, for a level 3 offender;
Semi-annually for 40 years, for a level 4 offender; and
Quarterly for life, for a level 5 offender.
Increases the registration fee for an offender from $50 to $80 (Sec. 3).
Authorizes an offender other than a level 5 offender to petition the district court for exemption from registering as an offender if certain requirements are met, including, but not limited to, the following requirements (Sec. 5):
The offender has completed half of his or her full registration term;
The offender demonstrates that he or she has maintained continuous time in the community; and
The offender provides a current psychosexual evaluation by a certified evaluator.
Specifies that a level 5 offender may be monitored with electronic monitoring technology for the duration of his or her probation or parole, whereas existing law requires an individual designated as a “violent sexual predator” to be monitored (Sec. 4).
