Title: Amends Minimum Wage for Employees Receiving Gratuities

Vote to pass a bill that amends the minimum wage for an employee receiving gratuities.

Highlights:

  • Requires an employer to pay an “employee receiving gratuities” one of the following wages (Sec. 1):
    • At least $8 per hour, if the sum of the wage and gratuities averages at least $12 per hour; or
    • The applicable minimum wage, if the employee does not earn sufficient gratuities so that the sum averages least $12 per hour.
  • Defines “employee receiving gratuities” as an employee who “customarily and regularly” receives at least $30 per month in gratuities (Sec. 1).
  • Requires an employer to provide a potential employee who may receive gratuities with a written copy of the wages required by the provisions of this bill (Sec. 1).
  • Requires an employer to pay all employees the applicable minimum wage if the Minnesota Department of Human Rights makes at least 3 probable cause determinations of sexual harassment regarding the employer (Sec. 1).
  • Requires an employee to receive the full amount of a gratuity given through a debit, charge, or credit card (Sec. 2).
  • Repeals lower minimum wage requirements for foreign employees with a summer work visa who are given provisions for room and board at a “resort”, “hotel or motel”, or “lodging establishment” (Sec. 1).
