Title: Amends Definition of "Another" for Certain Criminal Offenses

fetus for the purpose of certain crimes, effective January 1, 2016.

Highlights:

  • Defines “fetus” as an unborn offspring that is between the embryo stage, which is at the end of the eighth week after conception or implantation, and birth (Sec. 2).
  • Exempts certain acts from the provisions of this bill including, but not limited to, the following acts (Sec. 2): 
    • Any act committed by the pregnant woman;
    • Any act performed by a physician at the request of the pregnant woman or her legal guardian, including, but not limited to, an act that results in the termination of a pregnancy; or
    • Any act performed as part of the lawful administration of medication

    • Any act committed at the request, direction, or for the benefit of a pregnant woman; or
    • Any act performed by a physician or other medical professional in the course of their medical duties, including, but not limited to, an act that results in the termination of a pregnancy.
