Title: Prohibits Discrimination Based on Sexual Orientation and Gender Idenity

  • Prohibits an employer from discriminating against an employee or a potential employee on the basis of “gender identity” or “sexual orientation” (Sec. 2).
  • Defines “gender identity” as an individual’s actual or perceived gender, appearance, mannerisms or other characteristics, with or without regard to the individual’s sex at birth (Sec. 1).
  • Defines “sexual orientation” as an individual’s actual or perceived orientation as heterosexual, homosexual or bisexual (Sec. 1).
  • Prohibits public agencies who offer certain services from discriminating on the basis of gender identity or sexual orientation, including, but not limited to, the following services (Sec. 2):
    • Jury duty;
    • Child care;
    • Charter or public schooling;
    • Health care or medical assistance; or
    • Public facilities or accommodations.
  • Exempts a religious organization or an expressive association from the provisions of this bill, if the following circumstances apply (Secs. 1 & 2):
    • The organization’s right of expressive association under the 1st amendment of the United States Constitution would be “significantly burdened;”
    • The organization’s primary purpose and function are grounded in religious teachings; and
    • The organization is not for profit.
