Title: Prohibits Abortion Based on Sex or Genetic Disability

Vote to pass a bill that prohibits an individual from performing an abortion based on sex or genetic disability, effective July 1, 2015.

Highlights:

  • Prohibits an individual from performing an abortion if the patient is seeking the abortion solely due to the following reasons (Sec. 8):
    • The sex of the fetus; or
    • The diagnosis of or potential for a genetic “disability”.
  • Defines genetic “disability” as a disease, defect, or disorder that is genetically inherited, including, but not limited to, the following disabilities (Sec. 8):
    • A physical or mental disability;
    • A physical disfigurement;
    • A physical or mental disease; and
    • Down syndrome.
  • Requires an authorized medical professional performing an abortion to inform the pregnant woman verbally and in writing of the prohibition of certain abortions at least 18 hours before the abortion (Sec. 6).
  • Specifies that an individual in violation of the provisions of this bill may be subject to the following penalties (Sec. 8):
    • Certain disciplinary sanctions, including, but not limited to, revocation or suspension of a practitioner’s license, probationary status, or a maximum fine of $1,000; or
    • Civil liability for wrongful death and medical malpractice.
  • Exempts a pregnant woman upon whom an abortion in violation of the provisions of this bill is performed from being prosecuted (Sec. 8).
