Title: Prohibits Production and Sale of Products Containing Microbeads

Vote to pass a bill that prohibits the production, manufacturing, and acceptance for sale of products containing "synthetic plastic microbeads."

Highlights:

  • Prohibits an individual from producing or manufacturing a personal care product containing synthetic plastic microbeads, with the exception of over-the-counter drugs, effective January 1, 2018 (Sec. 1).
  • Defines “synthetic plastic microbeads” as an intentionally added, non-biodegradable, solid plastic particle measuring less than 5 millimeters in size intended to aid in exfoliating or cleansing as part of a rinse-off product (Sec. 1). 
  • Defines “personal care product” as any article intended to be applied to the human body for cleansing, beautifying, promoting attractiveness, or altering the appearance of an individual, not including prescription drugs (Sec. 1).
  • Prohibits an individual from accepting for sale a personal care product that contains synthetic plastic microbeads, with the exception of over-the-counter drugs, effective January 1, 2019 (Sec. 1).
  • Prohibits an individual from producing and manufacturing an over-the-counter drug containing synthetic plastic microbeads effective January 1, 2019 (Sec. 1).
  • Prohibits an individual from accepting for sale an over-the-counter drug containing synthetic plastic microbeads, effective January 1, 2020 (Sec. 1). 
  • Establishes a fine of no less than $1,000 and of no more than $10,000 for an individual who violates these provisions, to be determined by the district court for the judicial district in which the violation occurred (Sec. 1).
