Title: Prohibits Discrimination Based on Sexual Orientation

Vote to pass a bill that prohibits discrimination based on sexual orientation or gender identity.

Highlights:

  • Prohibits the government, a business, or an institution from discriminating against an individual based on sexual orientation in certain circumstances, including, but not limited to, the following circumstances (Secs. 3-25): 
    • When hiring or firing an individual;
    • When granting or terminating access to financial services, brokerage services, credit, lending, and insurance;
    • When selling, purchasing, renting, or advertising for housing; and
    • When selecting participants for jury duty.
  • Expands the definition of “discriminatory practice” to include an act which because of “sexual orientation” results in the unequal treatment or separation of an individual (Sec. 2).
  • Defines “sexual orientation” as the actual or perceived heterosexuality, bisexuality, homosexuality, or “gender identity” of an individual (Sec. 2).
  • Defines “gender identity” as the actual or perceived gender-related identity, appearance, mannerisms, or other gender-related characteristics of an individual, regardless of his or her designated gender at birth (Sec. 2).
  • Exempts a private club, religious organization, or organization operated in conjunction with a religious organization from requirements to provide services, employment, access, or membership to their organization unless membership is restricted because of race, color, or national origin (Secs. 3 & 19).
