Title: Extends Parental Rights in Education and Health Care

Vote to pass a bill that extends parental rights in education and health care.

Highlights:

  • Prohibits any state entity or institution from interfering with the following parental rights unless there is a compelling governmental interest (Sec. 1):
    • The right to direct the education of the minor child; and

    • The right to direct the moral or religious training of the minor child.

  • Specifies that a parent has the right to consent in writing before the state makes a video or audio recording of his or her child, unless the recording is used for safety demonstrations, classroom activity, a photo identification card, or security or surveillance video (Sec. 1).

  • Requires the Board of Education of a school district to create a policy promoting parental involvement with children enrolled in schools within that district including the following (Sec. 1):

    • Procedures by which a parent can review a course of study for his or her child;

    • Procedures by which a parent will be notified in advance of and given the opportunity to withdraw his or her minor child from any instruction or presentation regarding human sexuality; and

    • Procedures by which a parent can learn about the right to be exempt from any state immunization law.

  • Prohibits an individual or institution from performing a physical examination or surgical procedure on a child without the written consent of the parent, unless the situation is deemed a medical emergency (Sec. 1).

  • Specifies that an individual who violates provisions of this bill is guilty of an unclassified misdemeanor, punishable by a fine of not more than $1,000 or up to 1 year in prison, or both (Sec. 1).
