Title: Prohibits the Sale of Electronic Cigarettes to Minors

Vote to override a veto of a bill that prohibits the sale of electronic cigarettes to minors.

Highlights:
  • Prohibits individuals less than 18 years of age from purchasing, attempting to purchase, or possessing “alternative nicotine products” and “vapor products” (Sec. A).
  • Prohibits an individual or entity from selling, providing, or distributing “alternative nicotine products” and “vapor products” to individuals less than 18 years of age (Sec. A). 
  • Defines “vapor products” as non-combustible products containing nicotine that employ a heating element, power source, or other means to produce vapor from a nicotine solution, including, but not limited to, electronic cigarettes (Sec. A). 
  • Defines “alternative nicotine products” as non-combustible products containing nicotine that are intended for human consumption, excluding vapor products and tobacco products (Sec. A).  
  • Specifies that alternative nicotine products and vapor products are subject to local and state sales tax (Sec. A). 
  • Exempts alternative nicotine products and vapor products from being taxed and regulated as tobacco products, except as specified in this bill (Sec. A).
  • Requires an individual to attain a retail sales tax license for sale of alternative nicotine products, vapor products, and tobacco products (Sec. A). 
  • Specifies that a minor who purchases or attempts to purchase alternative nicotine products or vapor products will be subject to the same penalties as a minor who has purchased or attempted to purchase cigarettes or other tobacco products (Sec. A).
