Title: Establishes a State Entity to Oversee Medical Cannabis

Highlights:

  • Establishes the Division of Medical Cannabis Regulation and Enforcement within the Department of Alcoholic Beverage Control to create statewide minimum regulatory standards for medical cannabis (Sec. 2).
  • Establishes a statewide registration process to identify which entities are exempt from state criminal penalties for the cultivation, processing, manufacturing, testing, transportation, distribution, provision, donation, and sale of medical cannabis (Sec. 6).

  • Defines “mandatory commercial registrant” as any individual, partnership, or any other group acting as a unit to cultivate, process, possess, store, manufacture, test, transport, distribute, provide, donate, or sell medical cannabis (Sec. 6). 
  • Establishes the Medical Cannabis Regulation Fund within the State Treasury for the purposes of administering the provisions of this bill (Sec. 6).
  • Prohibits cities and counties from exceeding the number of dispensaries allowed by any applicable local ordinance (Sec. 6).
  • Specifies that the provisions of this bill do not prevent the authority of a city or county from imposing regulations based on local needs (Sec. 6).
