Title: Requires a "Kill Switch" on a Cell Phone

Vote to concur with House amendments and pass a bill that requires a cell phone to have a "kill switch" and amends the process to resell a cell phone.

Highlights:

  • Requires all new “smart phones” to be equipped with “preloaded antitheft functionality” or be capable of downloading that functionality at no cost to purchasers (Art. 1, Sec. 1).  
  • Defines "smart phone" as a cellular phone or other mobile device that meets the following criteria (Art. 1, Sec. 1): 
    • Is built on a smart phone mobile operating system;
    • Possesses advanced computing capability; and
    • Enables network connectivity.
  • Requires a wireless communications device dealer to keep certain information for each purchase or acquisition of a used wireless communications device that includes, but is not limited to, the following information (Art. 2, Sec. 1):
    • An accurate account or description of the wireless communications device purchased or acquired; 
    • The seller’s name and address;
    • The seller’s driver’s license number or another identification number from a government issued photo identification document; and
    • A statement signed by the seller attesting that the wireless communication device is not stolen.  
  • Requires wireless communications device dealers to pay for purchases of all used wireless communication devices by electronic transfer or check mailed to a specific address (Art. 2, Sec. 1).
