Vote to pass a bill that prohibits nondisclosure or confidentiality provisions from being included in a state employee settlement agreement.

Highlights:

• Prohibits personnel settlement agreements between a state employee and employer from containing any confidentiality or nondisclosure provisions (Sec. 2).

• Specifies that existing confidentiality or nondisclosure provisions in any state personnel settlement agreement are now void and unenforceable (Sec. 2).

• Requires all personnel settlement agreements to be made accessible to the public on the internet (Sec. 2).

• Requires the following information about a state employee to be public record, retroactive to January 1, 2004 (Secs. 1 & 6):
• That an employee resigned in lieu of termination;
• That an employee was demoted; and
• The documented reasons and rationale for an employee’s discharge, resignation in lieu of termination, or demotion.

• Requires the following information regarding “bonus pay” for any employee of the executive branch to be made public record and to be accessible to the public on the internet (Sec. 3):
• The decision to provide “bonus pay;”
• The documented reasons and rationale for “bonus pay;” and
• The amount paid in the form of “bonus pay.” 

• Defines “bonus pay” as additional remuneration provided to an employee in the form of a bonus, including, but not limited to, a retention bonus, a recruitment bonus, or a job performance bonus (Sec. 3).
