Title: Prohibits Medicaid Expansion

Vote to concur with Senate amendment and pass a bill that prohibits Medicaid expansion unless approved by the legislature, and amends contract laws between the Kansas medical assistance program and a state managed care organization.

Highlights:

  • Prohibits the eligibility standards for Medicaid from being expanded, as provided in the Patient Protection and Affordable Care Act of 2010 and the Health Care and Education Reconciliation Act of 2010, unless the Kansas legislature “expressly consents to” and approves of the expansion (Sec. 2). 
  • Requires a contract between the Kansas medical assistance program and any state managed care organization to require the processing and full payment of the allowed amount or processing an denial by the organization of the following claims, whereas existing law specified the processing and payment or processing and denial by the organization (Sec. 1):
    • All clean claims within 30 days after receipt of the clean claim; and
    • All claims within 90 days after receipt of the claim.
  • Authorizes a provider who has a claim that remains unpaid by a managed care organization after the time limits specified under the provisions of this bill to bring a direct cause of action against the organization (Sec. 1).
