Highlights:

  • Authorizes the Speaker of the House of Representatives or the President of the Senate to intervene in a judicial proceeding in which the constitutionality of a Kentucky statute or constitutional provision is challenged, if the Governor or Attorney General performs any of the following actions (Sec. 1):
    • Decline to defend a statute or constitutional provision;
    • Decline to present as affirmative defense interests in the law that the General Assembly relied upon when voting to enact the statute or constitutional provision; or
    • Defend a statute or constitutional provision in a manner deemed inadequate by the Speaker of the House of Representatives or the President of the Senate.
