Title: Requires Yearly Employee Consent for Paycheck Deductions by Public Labor Organizations

Vote to pass a bill that requires yearly employee consent for earnings deductions by a public labor organization.

Highlights:

  • Prohibits withholding any sum from a public employee’s earnings to pay for any dues, “agency shop” fees, or any other fees when the employee is one of the following (Sec. A):
    • An individual who is a member of a public labor organization;
    • An individual who is not a member of a public labor organization except upon annual written authorization; or
    • An individual who is not a member of a public labor organization.
  • Defines “agency shop” as an arrangement that requires an employee either to join the recognized employee organization or to pay the organization a service fee as a condition for continued employment (Sec. A). 
  • Prohibits a public labor organization from using or obtaining dues, agency shop fees, or any other fees paid to the public labor organization, unless a written authorization from a member or non-member has been received within the past 12 months (Sec. A).
  • Specifies that individuals who do not authorize contributions or expenditures will not have their dues, agency shop fees, or any other fees increased in place of contributions or expenditures (Sec. A).
  • Prohibits the signing or refraining from signing an authorization form from being made a condition of employment or continued employment (Sec. A).
  • Exempts “first responders” or any labor organization that represents such individuals from written authorization requirements (Sec. A).
  • Defines “first responders” as including, but not limited to, the following (Sec.  A):
    • Police officers;
    • Firefighters;
    • Ambulance attendants and drivers; and
    • Registered nurses and physicians.
