Vote on a motion to declare a bill inexpedient to legislate that authorizes the recreational use of marijuana, effective July 1, 2014.

Highlights:

• Authorizes an individual 21 years of age or older to possess, consume, use, display, obtain, purchase, or transport marijuana accessories or marijuana in the amount of 1 ounce or less, including up to 5 grams of hashish (Sec. 2).

• Prohibits an individual 21 years of age or older from personal marijuana cultivation unless the following requirements are met (Sec. 2):
• Plants are grown in an area not subject to public view;
• Plants are reasonable secure from unauthorized access; and
• Plants are only grown on property the cultivator legally owns, leases, or controls or with consent of the legal property owner.

• Classifies that a violation of the personal marijuana cultivation requirements as outlined by this bill will result in a fine of no more than $750 (Sec. 2). 

• Prohibits an individual from smoking marijuana in a public place (Sec. 2).

• Classifies that a violation of the public smoking prohibition as outlined in this bill will result in a fine of no more than $100 (Sec. 2).

• Authorizes the lawful operation of marijuana-related facilities if undertaken by an individual 21 years of age or older with a valid operating license (Sec. 2). 

• Establishes a tax on marijuana sold or transferred from a “marijuana cultivation facility” to a product manufacturing facility or a “retail marijuana store” at a rate of $30 per ounce (Sec. 3).

• Establishes a tax on marijuana sold or transferred from a “retail marijuana store” at a rate of 15 percent (Sec. 3).

• Requires the Department of Revenue Administration to adopt procedures for the issuance, renewal, suspension, and revocation of a license to operate a “marijuana establishment” (Sec. 3).
