Vote to pass a bill that requires paint manufacturers to establish recycling or "take-back" programs, effective July 1, 2015.

Highlights:

• Requires a “producer” of “architectural paint” to participate in a “paint stewardship program” for “postconsumer architectural paint” (Sec. 1). 

• Defines “producer” as an original producer of “architectural paint” that sells, offers for sale, or distributes architectural paint within or into Colorado under their own name or a brand that the producer manufactures (Sec. 1). 

• Defines “architectural paint” as an interior or exterior architectural coating sold in a container of 5 gallons or less, and does not include industrial, original equipment manufacturer, or specialty coatings (Sec. 1). 

• Defines “postconsumer architectural paint” as unused and unwanted paint in a container of 5 gallons or less (Sec. 1).

• Defines “paint stewardship program” as a program that is implemented statewide and includes the following conditions (Sec. 1):
• The collection, transportation, reuse, recycling, and disposal of postconsumer architectural paint; and
• The initiatives in place required to reduce the generation of postconsumer architectural paint. 

• Requires a producer, group of producers, or stewardship organization to submit a paint stewardship program plan to the Executive Director of the Department of Public Health and Environment that includes, but is not limited to, the following conditions (Sec. 1):
• The description of environmentally sound collection, transportation, reuse, recycling, and disposal standards;
• The description of the manner in which the program will collect the paint; and
• The methodology for conducting and determining the effectiveness of the program annually. 

• Establishes a collection system for paint based on the following criteria (Sec. 1):
• A minimum of 90 percent of residents must have a collection site within a 15-mile radius of their homes;
• A permanent site must be provided for every 30,000 residents of an urbanized area; and
• A plan for collection events held at least once a year for residents who do not have a permanent collection site within a 15-mile radius of their homes. 

• Establishes a “paint stewardship assessment” to be added to the purchase price of paint for retailers in order to fund the paint stewardship program (Sec. 1).

• Defines “paint stewardship assessment” as an amount that a producer participating in a paint stewardship program adds to the purchase price of a container of architectural paint (Sec. 1).

• Prohibits paint stewardship programs from charging customers for the collection of paint (Sec. 1).

• Prohibits producers from creating fees that collect more than the actual cost of the paint stewardship program (Sec. 1).
