Vote to pass a bill that prohibits the Environmental Rules Board from adopting a rule that is more limiting than a corresponding federal rule, effective July 1, 2014.

Highlights:

• Prohibits the Environmental Rules Board from adopting a rule or standard that is more “stringent” than a corresponding federal rule or standard (Sec. 1).

• Requires the Department of Environmental Management to provide notices to the Indiana Registry including, but not limited to, the following (Secs. 2 & 3):
• A notice that specifies that the proposed requirement is not more “stringent” than a federal requirement; and
• A notice that identifies the potential fiscal impact and the expected benefit of a proposed requirement in a subject area for which there is no federal requirement.

• Prohibits the Environmental Rules Board from adopting a hazardous waste facility requirement that is more “stringent” than a requirement established by the Administrator of the United States Environmental Protection Agency (EPA) (Sec. 4).
