Title: Authorizes an Individual to Refuse Services Based on Religious Beliefs

Vote to pass a bill that authorizes an employee to deny services to certain individuals on the basis of the employee's religious beliefs.

Highlights:

  • Prohibits an individual or religious entity from being required by a governmental entity to perform certain actions that would be contrary to the religious beliefs of the individual or entity regarding sex or gender including, but not limited to, the following actions (Sec. 1):
    • Providing services or facilities;
    • Providing foster care or social services;
    • Solemnizing a marriage, domestic partnership, or civil union; or
    • Treating a marriage, domestic partnership, or civil union as valid. 
  • Prohibits the following actions from occurring against an individual or religious organization that refused to engage in an activity as authorized by this bill (Sec. 2):
    • A civil claim or cause of action under state or local law; or
    • A government entity penalizing, withholding benefits from, discriminating against, or disadvantaging an individual or religious organization. 
  • Requires an employer to perform the following actions if an employee refuses to engage in an activity as authorized by this bill (Sec. 2):
    • Provide another employee who can provide such services; or 
    • Ensure that the requested service is provided, if it can be done without “undue hardship” to the employer.
