Vote to pass a bill that requires courts to assess a sanction on an attorney, law firm, or party in violation of the rules regarding representations made to the court.
Requires a sanction to be assessed on an attorney, law firm, or party who is determined to be in violation of the rules regarding the representations of pleadings, written motions, or other papers made to the court, whereas existing law authorizes a sanction to be assessed (Sec. 2).
Requires the sanction on an attorney, law firm, or party to include payment of “reasonable” attorneys’ fees and costs of the parties that were injured by the attorney, law firm, or other party’s conduct (Sec. 2).
Repeals the prohibition of filing a motion for sanction to the court for instances where the challenged paper, claim, defense, contention, or denial is withdrawn or corrected within 21 days of the motion for sanctions (Sec. 2).
