Title: Amends Animal Abuse and Neglect Laws

Vote to override a veto of a bill that amends animal abuse and neglect laws.

Highlights:

  • Classifies the stealing of a livestock animal as a class B felony if the value of the livestock exceeds $10,000 (Sec. A).
  • Requires an individual who “knowingly” fails to provide “adequate control” of an animal for at least 12 hours to be guilty of animal trespass (Sec. A).
  • Classifies the following penalties for animal trespass (Sec. A):
    • For the first conviction:
      • A fine of no more than $200; and  
      • A class C misdemeanor punishable by imprisonment or a fine of no more than $500.
    • For the second and all following convictions:
      • A fine of no more than $200; and
      • A class C misdemeanor punishable by imprisonment or a fine of no more than $500, or both.
  • Requires an individual convicted of animal abuse to knowingly fail to provide adequate care which results in harm to the animal, whereas existing law only required an individual to knowingly fail to provide adequate care (Sec. A).
  • Prohibits a foreign business from acquiring agricultural land in the state if the total aggregate foreign ownership of agricultural acreage exceeds 1 percent of the total aggregate agricultural acreage (Sec. A).
  • Requires the director of the Department of Agriculture to approve all proposed agricultural acquisitions and determine if the proposed sale is compliant with the foreign ownerships thresholds established by this bill (Sec. A).
