Title: Establishes Certain Regulations for Home Care Aides

Vote to pass a bill that establishes certain regulations for home care aides.

Highlights:

  • Establishes a registry on The State Department of Social Services’ website containing the following information regarding home care aides or home care organizations (Sec. 2):
    • The name, certification or license status, and certificate or license number;
    • The name and geographic information of the employers or organization; and
    • The any completed disciplinary actions taken against workers or organization.
  • Specifies that the licensure and certification fees will be equivalent to the cost of administering the licensure program (Sec. 2). 
  • Requires a home care organization to satisfy the following requirements to obtain a license (Sec. 2):
    • The organization must provide an application, including the required fees;
    • The organization must provide proof of general and professional liability insurance;
    • The organization must provide proof of a valid workers compensation policy;
    • The organization must provide a complete list of its’ home care aides; and
    • The organization must provide a background clearance of the owner or owners of the organization.
  • Requires a home care organization to ensure potential new hires meet the following requirements before hiring an individual as a home care aide on or after January 1, 2015, and to ensure its’ home care aides employed before January 1, 2015 meet the following requirements no later than July 1, 2015 (Sec. 2):
    • The individual undergoes an individual interview;
    • The individual provides at least 2 references; 
    • The individual demonstrates that he or she possesses sufficient language and reading skills; and
    • The individual provides proof of certification as a home care aide.
  • Prohibits home care aides from accepting money or property from a client without written permission from the home care organization (Sec. 2).
  • Classifies a violation of this bill as a civil penalty on an individual or entity, not to exceed $900 per day for each calendar day that the violation persists (Sec. 2).
