Title: Amends State Property Sale Procedures

Vote to concur with Senate amendments and pass a bill that amends procedures for buying and selling state property, effective immediately.

Highlights:
  • Requires the Long-Range Capital Planning Commission to work to decrease the amount of property owned by the state, return state-owned property to private sector ownership, “better maintain” and utilize the state’s needed capital assets, and eliminate the practice of state agencies leasing property not owned by the state (Sec. 2).
  • Requires the Long-Range Capital Planning Commission to prepare each year an annual capital plan budget and a state capital plan for addressing state capital facility needs for the ensuing 8 years that includes certain information including, but not limited to, the following information (Sec. 9):
    • An assessment of the inventory of capital facilities held by the state and any recommendations on reallocation, reuse, or liquidation of properties; and
    • Agency strategic facility plans for facilities that should be reallocated or liquidated.
  • Requires funds from the sale of any state property to be deposited in the Maintenance of State Buildings Revolving Fund and to be used exclusively for the maintenance and repair of state-owned properties and buildings (Sec. 1).
  • Authorizes the Office of Management and Enterprise Services to recommend state-owned properties for sale based on the value of the property and the potential for net gain for the state (Sec. 1).
  • Requires any state agency, board, commission, or public trust entering into or renewing a lease for property, or purchasing property or constructing a building to receive approval for that action from the Office of Management and Enterprise Services (Sec. 2).
  • Requires the Office of Management and Enterprise Services to determine prior to an approval of the action if the applicant entity can utilize already existing state-owned property as an alternative to the entity’s request (Sec. 2).
  • Exempts the Oklahoma Ordnance Works Authority and The Commissioners of the Land Office from the provisions of this bill (Sec. 9).
