Vote to pass a bill that establishes regulations for the retail marijuana industry.

Highlights:

• Authorizes an individual who meets the following conditions, on or after October 1, 2013, to apply for a “retail marijuana establishment” license for the sale, cultivation, manufacturing or distribution of “retail marijuana” (Sec. 5):
• The individual is operating a licensed medical marijuana center; 
• The individual is operating an optional premises cultivation license;
• The individual is operating a licensed medical marijuana-infused products business; or
• The individual has a pending application with the state licensing authority prior to December 10, 2012;
• The individual has paid all applicable licensing fees; and
• The individual has not yet had the application approved. 

• Defines a “retail marijuana establishment” as any of the following outfits (Sec. 5):
• A retail marijuana store;
• A retail marijuana cultivation facility;
• A retail marijuana manufacturer; or
• A retail marijuana testing facility.

• Authorizes the State Licensing Authority to establish limitations upon retail marijuana production through one or more of the following methods (Sec. 5):
• Limiting the number of licenses issued, by class or overall;
• Limiting the amount of production permitted by a retail marijuana cultivation license; or
• Limiting the total amount of production by retail marijuana cultivation licenses in the state.

• Defines “retail marijuana,” as marijuana that is cultivated, manufactured, distributed, or sold by a licensed retail marijuana establishment (Sec. 5).

• Authorizes an individual to operate a medical marijuana licensed operation and a retail marijuana establishment at the same location (Sec. 5).

• Establishes the following fees for certain individuals applying for a retail marijuana establishment license (Sec. 5):
• $500 for an individual applying for a retail marijuana establishment license who is already a medical marijuana establishment license holder; and
• $5,000 for a first-time applicant of a retail marijuana establishment license.

• Specifies that local jurisdictions can prohibit or restrict the operation of retail marijuana establishments (Sec. 5).

• Authorizes a retail marijuana store to either grow its own retail marijuana, provided that the owner obtains a retail marijuana cultivation facility license, or to purchase it from a separate licensed cultivation facility (Sec. 5).

• Prohibits retail marijuana stores from selling more than .25 ounces of retail marijuana product during a single transaction to a non-resident (Sec. 5).

• Requires the State Licensing Authority to develop a seed-to-sale tracking system and to define the rules for the regulation and control of the cultivation, manufacturing, distribution, sale, and testing of retail marijuana and retail marijuana products (Sec. 5).

• Requires the State Licensing Authority to establish an independent testing and certification program, which requires the licensees to test marijuana to ensure that the products are correctly labeled and do not contain contaminants that are injurious to an individual’s health (Sec. 5).

• Requires the label on retail marijuana and retail marijuana products to contain certain information including, but not limited to, the following information (Sec. 5):
• The potency of THC and other chemicals;
• The list of nonorganic pesticides and other chemicals used during cultivation;
• The health risk warning labels;
• The amount of THC per serving and the number of servings per package;
• The list of ingredients, possible allergens, and expiration dates for retail marijuana products; and
• The nutritional fact panel for edible marijuana products.
