Title: Prohibits the Enforcement of the Immigration Executive Order

Vote to adopt an amendment to HR 2217 that prohibits funds appropriated by this bill from being used to enact certain memos issued by the Department of Homeland Security and U.S. Immigration and Customs Enforcement regarding immigration and deportation.

Highlights:

  • Prohibits funds appropriated by this bill to the Department of Homeland Security from being used to finalize, implement, administer, or enforce the following documents:
    • A memo from the Secretary of Homeland Security that states that noncitizens who were brought to the United States under the age of 16 years and meet other criteria are low priority and are authorized to be considered for prosecutorial discretion;
    • A memo from the Director of U.S. Immigration and Customs Enforcement that prioritizes the deportation of noncitizens who are suspected of terrorism or espionage, convicted of violent crimes and felonies, participating in criminal gangs, or otherwise considered to pose a risk to national security or public safety;
    • A memo from the Director of U.S. Immigration and Customs Enforcement that provides guidelines for prosecutorial discretion in removal proceedings of noncitizens;
    • A memo from the Director of U.S. Immigration and Customs Enforcement that provides guidelines for prosecutorial discretion in removal proceedings of noncitizens who are victims and witnesses of crime and noncitizens involved in “non-frivolous” efforts related to the protection of  his or her civil rights and liberties;
    • A memo from the Principal Legal Advisor of U.S. Immigration and Customs Enforcement, which states that the Office of the Principal Legal Advisor (OPLA) will begin reviewing cases that are to be heard by the Executive Office for Immigration Review (EOIR) to ensure that all the cases reviewed conform with the deportation priorities outlined by the Director of U.S. Immigration and Customs Enforcement; and
    • A memo from the Director of U.S. Immigration and Customs Enforcement that provides guidelines for the use of detainers for noncitizens that conform with the deportation priorities the Director outlined in a previous memo.
