Title: Requires Individuals to Opt-Out of Immunization Registry

Vote to pass a bill that amends immunization record keeping procedures, effective January 1, 2015.

Highlights:

  • Amends immunization record keeping procedures so that an individual under the age of 18 is automatically included in the state immunization registry, whereas existing law required an individual’s consent prior to inclusion (Sec.1).
  • Authorizes an individual or a legal representative to request that the individual’s information be removed from the immunization registry at any time, including, but not limited to, the following opportunities (Sec. 1):
    • Each time the individual receives any immunization administered by a health care provider;
    • Through electronic submission of a request on the Department of State Health Services website; or
    • Through submission of a written request to the Department of State Health Services.
  • Requires health care providers to notify the individual or a legal representative that the immunization information will be included in the registry and of the procedures for requesting removal from the registry (Sec. 1).
  • Prohibits the Department of State Health Services from selling registry information to any public or private entity and from releasing individually identifiable information from the registry for external public health research unless given permission from the individual or the individual’s legal representative (Secs. 1 & 4).
