Title: Requires Certain Information From Donation-Seeking Charities

Vote to pass a bill that requires certain information from donation-seeking charities, effective January 1, 2014.

Highlights:
  • Requires organizations that solicit charitable contributions to register with the Secretary of State by filing a form with certain information, including, but not limited to, the following (Sec. 3):
    • The financial report from the most recent fiscal year;
    • The purpose of the organization;
    • The names, addresses, and telephone numbers of any offices and officers of the organization; and
    • The organization’s tax-exempt status.
  • Defines “charitable contribution” as a tax deductible contribution as recognized by the Internal Revenue Service (IRS) (Sec. 2).
  • Defines “solicit charitable contributions” as any request for a contribution, donation, or gift that is made, including, but not limited to, requests via mail, telephone, or face-to-face meeting (Sec. 3).
  • Specifies that all information filed with the Secretary of State is considered to be public record and will be posted on the Secretary of State’s website (Secs. 3 & 4).
  • Establishes a civil penalty of $1,000 if an organization fails to file the required information within 90 days after receiving notice from the Secretary of State (Sec. 5).
  • Requires an individual soliciting charitable contribution on behalf of a registered organization to disclose the following information, unless the solicitation is directed to less than 15 individuals or to blood-relatives of the organization’s officers, directors, trustees, or executive personnel  (Sec. 12): 
    • The full legal name of the organization as registered with the Secretary of State;
    • The state or jurisdiction in which the organization was formed;
    • The purpose of the organization; and
    • The contribution’s tax-exempt status.
