Title: Prohibits Sex-Selective Abortions

Vote to pass a bill that prohibits sex-selective abortions, effective October 1, 2013.

Highlights:

  • Prohibits an individual from performing an abortion if he or she has knowledge or “an objective reason to know” that a significant factor for the pregnant woman seeking the abortion is related to the sex of the unborn child (Sec. 1).
  • Prohibits a physician from being required to inquire as to whether or not the sex of the unborn child is a significant factor in the pregnant woman seeking the abortion (Sec. 1).
  • Authorizes the following individuals to seek a claim of injunctive relief against an individual who violates the provisions of this bill (Sec. 1):
    • The patient the abortion was performed upon;
    • The spouse, guardian, or current or former health care provider of the individual whom the abortion was performed upon; or
    • The parent of the individual whom the abortion was performed upon if the individual was a minor at the time of the abortion.
  • Requires an individual who violates the provisions of this bill to pay the following fines (Sec. 1):
    • $10,000 for the first violation;
    • $50,000 for the second violation; and
    • $100,000 for the third violation and each subsequent violation thereafter. 
  • Prohibits penalties from being assessed against the patient who undergoes an abortion or attempted abortion (Sec. 1).
