Title: Extends Worker's Benefits to Farm Laborers

Vote to pass a bill that extends worker's benefits to include farm laborers.

Highlights:

  • Repeals exemptions for employers of farm laborers and requires an employer to provide certain workers’ benefits and employment conditions to farm laborers including, but not limited to, the following provisions of benefits and conditions (Sec. 9-11, 15 & 16).
    • The provision of worker’s compensation, unemployment, and disability benefits; 
    • The provision of wages that are at least the state minimum wage; and
    • The provisions of sanitary conditions in farm and food processing labor camps occupied by at least 1 migrant worker.
  • Prohibits an individual or corporation operating a farm from requiring an employee to work more than 8 hours per day or more than 40 hours per week (Sec. 7).
  • Requires an employer of farm laborers to pay their employees at least 1.5 times their normal wage rate for any overtime work (Sec. 7).
  • Authorizes a farm laborer to take at least 24 consecutive hours of rest per week (Secs. 3-5).
  • Authorizes a farm laborer to use a representative, labor organization, or company union for the purpose of collective bargaining (Sec. 2)
  • Prohibits an employer from discharging or discriminating against an employee for requesting a claim form for injuries received in the course of employment (Sec. 14).
  • Requires a farm labor contractor, foreman, or supervisor to inform the employer, owner, or operator of a farm of any injury incurred by a farm laborer during the course of their employment (Sec. 13).
