Title: Requires Photo Radar Systems To Be Necessary for Public Safety

Vote to concur with Senate amendments and pass a bill that requires highway photo enforcement systems to be proven necessary for the public safety of the state before installation.

Highlights:

  • Prohibits the installation of photo enforcement systems on state highways unless the city or town provides proof to the Department of Transportation that the photo enforcement system is necessary for public safety and attains a permit or enters into a contract with the Department for use of a right-of-way (Sec. 1).
  • Requires the Department of Transportation to publish on its website the following information to determine the necessity of a photo enforcement system (Sec. 1): 
    • The current operational speed studies, including the average number of vehicles operating per day on the section of state highway and percentage of vehicles in violation of existing road laws; and
    • The reports of motor vehicle accidents on the section of the state highway that is subject to the proposed photo enforcement system. 
  • Specifies that this bill does not apply to an installed photo enforcement system on a state highway on the effective date of this bill, except when the permit or contract for the photo enforcement system expires or is renewed (Sec. 1).
