Vote to pass a bill that requires individuals convicted of an aggravated misdemeanor to submit a DNA sample, effective July 1, 2014.

Highlights:
  • Requires an individual who is convicted of an aggravated misdemeanor to submit a DNA sample to the Division of Criminal Investigation (Sec. 2). 
  • Authorizes an individual who was previously convicted of an aggravated misdemeanor but was not required to submit a DNA sample to ask the court to order that DNA analysis be performed on the evidence used for his or her conviction (Sec. 3).
  • Exempts an individual from the provisions of this bill if he or she was convicted of any of the following offenses (Sec. 1):
    • A hazardous waste offense;
    • An agricultural production offense; 
    • A gaming and betting offense;
    • A motor vehicle or traffic violation; or
    • A second offense for operating while under the influence of alcohol or a drug, unless the individual has more than one previous revocation within the immediate past 12 year period due to an operating under the influence of alcohol or a drug offence.
