Title: Establishes the Charlotte International Airport Authority

Vote to concur with House amendments and pass a bill that establishes the Charlotte International Airport Authority.

Highlights:

  • Establishes the Charlotte International Airport Authority as a corporate and political body with jurisdiction over the Charlotte Douglas International Airport (Sec. 2).
  • Requires the Authority to consist of the following 11 members (Sec. 4):
    • 4 registered voters from the city of Charlotte;
      • 2 of whom are appointed by the Mayor and 2 of whom are appointed by the City Council.
    • 1 registered voter each from Mecklenburg, Cabarrus, Gaston, Iredell, Lincoln, and Union counties, appointed by that respective county’s Board of Commissioners; and
    • 1 member appointed by the other 10 members of the Authority.
  • Requires the City of Charlotte to transfer its right, title, and interest to the Charlotte Douglas International Airport, including all property and all liabilities, to the Authority when this bill becomes law (Sec. 7).
  • Requires members of the Authority to serve 4 year terms and authorizes members to serve up to a total of 2 successive terms (Sec. 4).
  • Requires the Authority to assume certain responsibilities including, but not limited to, the following responsibilities (Sec. 6): 
    • The charging and collecting of fees, royalties, and rent for the use of any property owned or otherwise controlled by the Authority; 
    • The purchasing of real and personal property; 
    • The maintaining of an office or offices within Mecklenburg County;
    • The selling, exchanging, leasing, subleasing, or otherwise disposing of any property real or personal, belonging to the Authority; and
    • The making of all reasonable rules, regulations, and policies for any airport or airport facility owned, leased, subleased, or controlled by the Authority. 
  • Requires the initial budget of the Authority to be the same as the budget planned by the Charlotte City Council for the Airport during the 2013-2014 fiscal year (Sec. 5).
  • Requires the Authority to reimburse the City of Charlotte with compensation equal to the unrecovered costs of acquiring the Airport property that was not paid with Airport funds or through the proceeds of federal, state, or private grants (Sec. 7). 
  • Establishes the position of Charlotte Regional Airport Authority Executive Director, who shall manage the affairs of the Authority under the supervision of the Authority and receive a fixed compensation (Sec. 6).
  • Requires the Authority to appoint the Aviation Director of the City of Charlotte as its’ initial Executive Director by February 14, 2013 (Sec. 7).
