Highlights:
  • Classifies the death of a fetus caused by a wrongful act, neglect, or default as a felony (Sec. 2).  
  • Defines an “unborn child” as the offspring of human beings from conception until birth, whereas current law defines an “unborn child” as a fetus of at least 12 weeks of gestation (Sec. 1). 
  • Specifies that an individual is not liable under the provisions of this bill if the death of a fetus results from any of the following, including, but not limited to (Sec. 2):
    • A legal abortion;
    • An action by the pregnant women; or
